SpaceX Falcon I rocket fails to orbit test satellite

The SpaceX Falcon 1 rocket has failed to place a DARPA demonstration payload into orbit, on its first flight into space. The rocket launched from Omelek Island, at 01:10 GMT on 21 March, just less than a year after its maiden flight which failed just seconds after launch.

The rocket, which is the first privately-funded liquid-fueled launch vehicle, was intended to place the payload into a low-Earth orbit, but all contact with the rocket was lost just over five minutes into the flight.

The first stage burn proceeded nominally, and separation occurred on schedule. As the first stage fell away from the second, it was observed to have impacted on the engine bell of the second stage. About five minutes into the flight, the second stage began to roll out of control. All data was lost at T+5 minutes, 5 seconds.

UK Serious Fraud Office to investigate MG Rover collapse

The United Kingdom’s Serious Fraud Office is to launch an investigation into the collapse of car manufacturer MG Rover. The move follows the conclusion of a four-year enquiry started immediately after the firm became insolvent.

The group of four who owned MG Rover — John Towers, Nick Stephenson, Peter Beale and John Edwards — have been accused of asset stripping. The quartet, known as the Phoenix Four, paid a symbolic £10 (approximately €15) for Rover in 2000. At that time the company received an interest-free loan from former owner BMW for £427 million (approximately €700 million) and came with a large amount of unsold stock.

Between then and Rover’s April 2005 bankruptcy, by which time there were unpaid debts of £1 billion (approximately €1.5 billion), the Phoenix Four had removed an estimated £40 million worth of assets including pensions and salaries. An enquiry was launched by ministers that was expected to take a year, but the final report was not delivered to business secretary Lord Mandelson until three weeks ago.

The government used taxpayer’s money to fund a £6 million loan to MG Rover and attempted to negotiate a deal with a Chinese company, but these efforts failed. MG Rover’s collapse caused the loss of an estimated 15,000 jobs, including with various suppliers. A former MG Rover factory does still build a small number of MG sports cars in Longbridge by Shanghai Automotive Industry Corporation, who bought most of the designs.

The Phoenix Four released a statement criticising the criminal investigation. “There has never been any suggestion of improper conduct by the directors and this was confirmed in a report by the administrators PWC six months after they took over the running of the company. Four years on, any suggestion [of] another further investigation is frankly ridiculous and smacks of kicking this issue into the long grass. If the government has been so concerned to get to the heart of the matter why has it flatly refused more than 30 requests under the Freedom of Information Act which would have revealed correspondence and documents the directors believe would have shed some light on the government’s role in the affair?”

European airspace closed by volcanic ash

Hundreds of thousands of air travelers had their travel plans disrupted in Europe by volcanic ash from the Eyjafjallajökull eruption.

Tens of thousands of air travelers were stranded when all flights into and out of the United Kingdom were grounded, as it became one of the first nations to be affected. The grounding was even more extensive than that following the September 11 attacks of 2001 when only trans-Atlantic flights were canceled.

Eurocontrol released a statement saying “…most air traffic in the United Kingdom, Ireland, Denmark, Norway and Sweden is suspended.”

The grounding is because the volcanic ash drawn into the jet stream is of a particle size which allows it to remain aloft in the atmosphere. Ingestion of this foreign matter, because of its distribution, would lead to flame outs in all aircraft engines. The composition of the ash also means that it would first melt into glass if it were to enter the engine of an aircraft before solidifying again as it cooled. This could lead to damage to the compressors and fan blades, which would make it impossible to restart the engines, even if the aircraft were to exit the cloud.

The current contingency is informed by the experience of British Airways Flight 9, which on June 24, 1982 suffered just such complete engine flame outs when it flew through the plume of Mount Galunggung in Indonesia. In that case, the flight crew after many efforts was able to restart the engines, though one failed shortly after, and the aircraft landed without casualties.

The UK National Air Traffic Services (NATS) has stated that “restrictions will remain in place in UK controlled airspace until 1300 (UK time) tomorrow, Friday 16 April, at the earliest,” and that “We will review further Met Office information and at 0230 (UK time) tomorrow we will advise the arrangements that will be in place through to 1800 (UK time) tomorrow.” The NATS statement concluded “…the situation cannot be said to be improving”.

In addition to Northern Europe, the ash is drifting south; Berlin and Hamburg airports in Germany are closed, and airports in the Netherlands, Belgium and Northern France are described as now being closed or closing. Some flights from Spain and Portugal, together with upwards of 4,000 flights across Northern Europe, have been affected, and the knock-on effect of aircraft and crews out of position could disrupt air travel worldwide for up to 72 hours.

One affected group are British musicians booked to play at this weekend’s Coachella Festival in California. Amongst those stranded are Frightened Rabbit, Gary Numan, The Cribs and Bad Lieutenant.

Kiribati acquires international funding for solar power

Last Tuesday, AusAID Australia and the World Bank’s Global Environment Fund (GEF) reached an agreement to give the government of Kiribati US$5 million (AU$4,779,000, NZ$5,985,000, €3,885,000) to install solar panels around the country capital, located on the Tarawa atoll. According to Business Desk of the Brunei Times, AusAID promised AU$3.2 million in funding, while GEF promised US$1 million. The country was the first in the Pacific to make a deal with the World Bank.

The funding was part of a US$530 million (NZ$635 million) package announced at yesterday’s Pacific Energy Summit in Auckland involving New Zealand and the European Union, Australia, the Asian Development Bank, the European Investment Bank, the Japan International Cooperation Agency, the World Bank Group, and the United Arab Emirates. Also at the summit yesterday, New Zealand’s Foreign Affairs Minister Murray McCully had announced a national commitment of USD$54,262,000 (AU$51,861,000 NZ$65 million, €42,178,000) to Pacific region energy solutions, of which US$8,348,000 (AU$8 million, NZ$10 million, €6,483,000) would be specifically earmarked for renewable energy and improved energy efficiency in the Cook Islands, Kiribati, Papua New Guinea, Samoa, Tonga, and Tuvalu.

Kiribati is heavily dependent on diesel fuel for most of the energy available on the national power grid, which supplies power to half Kiribati’s population of 110,000. In addition, a third of the country’s population lacks access to electricity. Once installation of the solar panels is complete, they are estimated to reduce diesel consumption by 230,000 liters (60,760 gallons) a year and give access to the electricity to some parts of the population that currently have no electricity. The European Union already has committed €100 million to sustainable energy in the region, with €10 million of that coming as a result of an announcement made last week.

In a press release about the news, Kiribati President Anote Tong was quoted as saying, “Kiribati faces big challenges it is remote, it is at risk from the effects of climate change, and it is vulnerable to economic shocks. […] Shifting Kiribati’s focus to reliable solar energy will provide a more secure, more sustainable power source for the country’s people.” Radio New Zealand International quoted Tong as saying, “It’s the first time we are doing this. We’re excited at the prospect of even substituting fossil fuel to a small extent at this stage. What the system being envisaged will only produce around 500 kilowatts, but this is the beginning of what I hope will be a pattern, the trend in the future.”

The European Union’s Fiji-based head of operations for the Pacific region, Renato Mele, supported alternative energy solutions like solar power for the region, but said that solar power had limitations because climate and environmental conditions sometimes meant batteries required to power the panels had a life of only 12 months, compared to other climates where batteries normally last five years. This created the potential to drive up standard operating costs. Mele has also noted these additional costs though are still lower than the cost of diesel power.

One News Pacific Correspondent Barbara Dreaver noted, “Governments will be able to put the money they (currently) spend on diesel into things like education and health.”

Incomplete data may mislead doctors into overprescribing expensive medicines

Medical doctors have not been getting the full picture about newly FDA-approved drugs, concludes a research team from the University of California, San Francisco. This is because not all the studies required for FDA approval get published. New drug studies that do see publication tend to be ones where the medicine appears to perform well while poor and middling results are less likely to appear in medical journals. The result appears to be that doctors who read the available literature may get an inflated impression of new medications and may prescribe expensive new drugs in place of older medicines that perform as well or better. As Jordan Lite of Scientific American wonders, are drug companies cherry-picking the studies they publish to make their drugs look better than they actually are?

The University of California team reviewed trials that had supported new drugs approved from 1998 to 2000 and examined 909 trials of 90 medications. The search was conducted upon PubMed and other search tools that a typical medical doctor or patient could access. They concluded that less than half of the studies had been published five years after drug approval and a publication bias existed.

Erick Turner, who coauthored a similar study earlier this year, expressed concerns to Scientific American that the problem was not merely the raw percentage of studies published, but that a disproportionate share of the research that appeared in journals are examples where new medications appear to perform well:

When trials are selectively published … it will skew the efficacy of the drug and make it look like it works better than it does.

Ken Johnson, senior vice president of the Pharmaceutical Research and Manufacturers of America (PhRMA), defended the pharmaceutical industry by saying FDA review of new drug applications is more important than publishing the results of medication trials in medical journals. Approved medications come with labels that give patients and doctors enough information, assures Mr. Johnson.

Yet concerns about full and appropriate disclosure have been serious enough that a new law was enacted last year. FDA Amendments Act of 2007 (FDAAA) requires that all trials which support FDA-approved drugs be registered at the National Institutes of Health website. The requirement goes into effect this coming Saturday. Congress enacted the legislation in response to hearings that determined pharmaceutical companies were less likely to publish studies that indicated significant side effects. One shortcoming in the legislation, according to UCSF associate professor Ida Sim, is that the FDA is still not required to specify which trials it weighs when considering applications for drug approvals. Yet she praises the new law as a major improvement. It’s critically important that we know trials exist and that we get the summary results, positive and negative, into the public domain—that’s a huge step and more than any [other] country is doing now.

Retired U.S. vets sue Donald Rumsfeld for excessive service cutbacks

One thousand residents of the Defense Department-managed Armed Forces Retirement Home in Washington, D.C. filed a class-action lawsuit on May 24, asserting that the cut-backs in medical and dental services imposed by Secretary of Defense Donald Rumsfeld are illegal. The operating budget for the home was reduced from $63 million in 2004 to $58 million for 2005. The residents cite cuts in on-site X-ray, electrocardiogram, physical and dental services, and the closing of the home’s main clinic and an on-site pharmacy.

Chief Financial Officer Steve McManus responded that the changes not only save money but also achieved improved efficiencies. “We’re really trying to improve the benefits to our residents,” he said.

Most of the home’s costs are paid for by a trust fund and monthly fees paid by residents. By law, the Armed Forces Retirement Homes are required to fund, “on-site primary care, medical care and a continuum of long-term care services.”

Salient features of the revised norms of SEBI (Securities and Exchange Board of India) are as follows:

The requirements of the circular relating to the merger and amalgamation can be divided in to 2 parts:

? Requirements before the scheme is submitted for sanction of the High Court

? Requirement after the scheme is sanctioned by the High Court

REQUIREMENTS BEFORE THE SCHEME IS SUBMITTED TO THE HIGH COURT FOR ITS SANCTION:

Obligation of Listed companies/Stock exchange

1. Listed companies desirous of undertaking the scheme of arrangement under chapter V of the Companies Act shall file draft scheme with the stock exchange along with the following documents.

I. Valuation report from the Independent Charted accountant

II. Report from the audit committee recommending the scheme

III. Fairness of opinion by independent merchant banker

IV. Pre & post amalgamation shareholding pattern

V. Audited financial results of last 3 years

VI. Compliance with clause 49 of listing agreement

VII. Complaints report in prescribe manner

And shall choose one of the Stock Exchanges as the designated stock exchange for the purpose of coordinating with SEBI. Designated Stock Exchange shall forward the same to SEBI within 3 working days.

2. Listed Companies shall place before its Audit Committee the valuation report obtained from the independent charted accountant and Audit Committee shall give a report recommending the scheme.

3. The stock exchanges shall process the draft scheme and shall forward objection and no objection letter to SEBI within 30 days of the receipt of the draft scheme from the listed Company or within 7 days of the receipt of the satisfactory reply on any clarification sought by Stock Exchanges from Company or Independent charted Accountant.

4. The stock Exchanges shall issue the observation letter to the listed company within 7 days of the receipt of the comments from the SEBI on draft scheme.

5. The listed company shall disclose the draft scheme and the documents as stated in point 1 on its website within 24 hour of filling the same with stock exchanges.

6. The stock exchanges shall also disclose on their websites aforesaid draft scheme and documents immediately on the receipt of the same.

7. Listed companies shall ensure that approval of the shareholders by way of special resolution for the scheme is obtained by postal ballot and e-voting and the scheme shall also provide that SR shall not be acted upon if it is not supported by minority shareholders by a majority of 2/3rd or more.

8. Condition to be satisfied by listed entity for claiming exemption from strict enforcement of rule 19 (2) (b) of securities contract regulation rules, listing of securities without making initial public offer:

i. Equity shares proposed to be allotted to by unlisted entity to the shareholders of listed entity shall be allotted pursuant to the scheme of arrangement sanctioned by the high court under section 391-394 of companies act, 1956.

ii. At least 25% of post scheme aid up share capital of the transferee company shall be held by the public shareholders of transferor entity.

iii. Transferee entity shall not issue any shares which are not covered under the scheme.

iv. There shall be no outstanding warrants/instrument entitle the holder thereof to take shares in the transferee company at any future date, if there exist any such instrument, the minimum shareholding as discussed above shall be calculated on expanded share capital assuming full conversion of the said instrument.

v. Shares transferred in lieu of locked in shares shall be under lock-in for remaining period.

Processing of the draft scheme by SEBI

SEBI shall process the draft scheme forwarded to it by stock exchanges and may sought clarification from any person relevant in this regard. SEBI shall make endeavors to provide its comments on the draft scheme to the stock exchanges within 30 days of the latter of following:

Date of receipt of satisfactory reply to the clarification sought by SEBI, if any.

1. Date of receipt of fairness of opinion from independent charted accountant sought by SEBI, if any.

2. Date of receipt of no objection/objection from the stock exchange.

Manner of Approval of scheme by Shareholders

Listed companies shall ensure that the approval of the shareholders by way of special resolution for sanction of scheme is obtained through postal ballot and e-voting. Besides the scheme also provide that special resolution shall be acted upon if it is supported by 2/3rd or more of the total minority shareholders.

Redressal of Complaints Pertaining to the Scheme

1. All the listed complaints received by the SEBI pertaining to the draft scheme shall be forwarded to the designated stock exchange for necessary action and resolution by listed Company.

2. Listed Company shall, within 7 days of the expiry of 21 days from the date of filling draft scheme with the stock exchanges, submit a complaint report to the stock exchanges prior to obtaining observation letter, containing prescribed particulars and shall send the said complaint report to the shareholders along with the notice sent to the shareholders for seeking their approval for proposed scheme of Compromises and arrangement.

3. The stock exchange shall forward the Complaint Report to the SEBI before the issuance of comments by SEBI.

REQUIREMENTS AFTER THE SCHEME IS SANCTIONED BY THE HIGH COURT.

1. After the scheme is sanctioned by the Hon ble high court the listed Company shall Submitted the following Documents with the stock exchange.

I. Copy of the order of high court approving the scheme.

II. Result of the voting by shareholders approving the scheme.

III. Statement explaining the changes, if any and the reason thereof.

IV. Status of the compliance with the observation letter.

V. Application seeking the exemption from the strict enforcement of Rule 19 (2) (b) of securities Contracts (Regulation) Rules.

VI. Complaint Report.

2. The Designated stock exchange shall forward its recommendations to the SEBI on the aforesaid document and SEBI shall make all reasonable efforts to give its comments/approval within 30 days thereafter.

3. An unlisted issuer may make an application to the board through stock exchange claiming exemption from the strict enforcement of rule 19 (2) (b) of securities contract regulation rules if it satisfies the following condition:

I. Observation letter has been issued by stock exchanges

II. Listing of the equity shares is in terms schemes sanctioned by the High court.

III. Shares have been allotted by the unlisted issuer to the shareholders listed entity and share certificate has been dispatched or the names of allottees have been entered in the records of depositories.

4. The formalities for commencing trading shall be completed within 45 days of the order of the High court and transferee company shall give an advertisement containing the prescribed information about the transferee company in 1 English, 1 Hindi newspaper having nationwide circulation and in 1 regional language newspaper having wide circulation at a place where registered office of transferee entity is situated.

British doctor killed while on honeymoon

Catherine Mullany, a newly married British woman, and her husband, Ben Mullany, have been shot while on honeymoon in Antigua. Catherine died on the scene, while Ben is in a critical condition in Hospital.

The families of the Mullanys have described themselves as “deeply shocked and devastated.”

The incident occurred at 05:00 Antigua time (09:00 GMT) on Tuesday, and it is being treated by police as a robbery. A police spokesperson described the incident. “Shortly after 5am this morning officers from the Bolans Police station responding to a call, arrived at Cocos Hotel and Restaurant in the Valley Church area, the scene of a murder.” UK police have been asked to help in the inquiry.

Catherine Mullany was a doctor, who, before her death, planned to become a GP. Ben was a physiotherapy student at the University of the West of England (UWE), which is located in Bristol, England.
